Cosmic Draft — Terms of Service

• These Terms of Service ("Terms") are an agreement between you and Caretta 7 Studios Inc. ("Caretta 7 Studios", "we", "us", "our"), a corporation incorporated in the State of Texas, United States, covering your use of the game Cosmic Draft ("the Game").
• By downloading, installing or playing the Game you agree to these Terms and acknowledge our Privacy Policy (https://caretta7studios.com/games/cosmic-draft/privacy). If you do not agree, do not play.
• The same text is available inside the Game, offline, under Settings › Terms.

• The Game is intended for players who are at least 13 years old, or the higher minimum age of digital consent that applies where you live — up to 16 in parts of the European Economic Area.
• Thirteen is a minimum, and a parent's permission does not lower it. If you are under 13 you may not play.
• If you are at or above that age but under the age of majority where you live, you may play only with the permission and involvement of a parent or legal guardian, who accepts these Terms on your behalf and is responsible for any purchase you make.

• Cosmic Draft is a single-player space roguelike: runs, upgrades, bosses, permanent progression, a global leaderboard, ads, and optional purchases.
• We may change it. We may add, remove, rebalance or redesign content, weapons, abilities, prices, difficulty and features as the Game develops.

• We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to play the Game for your own entertainment, on devices you own or control, subject to these Terms and the rules of the store you obtained it from.
• We and our licensors keep every right not expressly granted to you.

• Do not cheat, exploit bugs for advantage, tamper with saved data, modify the Game, use automated play, manipulate the leaderboard, or reverse engineer the Game except to the extent the law says you may.
• Do not use the Game for anything unlawful, and do not attempt to interfere with our servers or other players' experience.
• We may remove scores, remove a leaderboard entry, limit features, or end your access if we reasonably believe any of the above is happening.

• The Game creates an anonymous account for you on first launch so that your progress can be saved. You do not choose a username or a password and we do not ask for your email address.
• Signing in with Google Play Games is optional. It links your progress to your Google account so it survives a new phone, and it is what puts you on the leaderboard and unlocks achievements.
• Your cloud save is readable only by your own account. It is not shown to other players.
• Progress can be lost for reasons outside our control — a device failure, a store account change, an interrupted sync. We back up what we reasonably can, but we do not guarantee that progress is never lost, and we are not able to reconstruct a lost save from nothing.
• You are responsible for your Google account and for the security of the device you play on.

If you sign in with Google Play Games, your Play Games display name, your score, your highest level and your run count are published on a leaderboard that every other signed-in player can see. If you do not sign in, nothing about you is published.

• The name comes from your Google Play Games profile. The Game has no field where you can type a name. To change how you appear, change your gamer name in the Google Play Games app — the leaderboard follows it. We cannot change it for you.
• Names must not be obscene, hateful, harassing or threatening; impersonate another person, a company or us; infringe anyone's trade mark or other rights; contain anyone's personal information; or advertise anything.
• We may refuse to display, alter or remove any leaderboard entry, and may remove a player from the leaderboard or end their access, where we believe a name or a score breaches these Terms. Because the harm is live while the entry is displayed, we may do this without prior notice.
• To report a leaderboard entry, email support@caretta7studios.com with the name you saw and roughly when you saw it. We review every report and act within a reasonable time.
• Scores must be earned through normal play. Tampered, automated or fraudulent scores are removed and the account may be barred from the leaderboard.
• We are not responsible for names or content another player brings to the leaderboard from their own platform account, beyond acting on reports as described above.
• Deleting your account removes your leaderboard entry — see Section 12.

• The Game shows ads, including rewarded ads that you choose to watch in exchange for something in the Game.
• Rewards are part of gameplay. They have no cash value and cannot be exchanged for money.
• Ads may be unavailable, interrupted or limited by your region, your device, your network, your privacy choices, the ad provider's rules, or simply a lack of ads to show. We do not owe you a reward for an ad that could not be shown.
• Declining changes which ads you see, and may change whether you see any. Where the consent form applies and you decline it, nothing about you is used to choose your ads; you may see basic ads chosen without any information about you, or none at all. Where no ads can be shown, the optional extras they pay for are unavailable until you change your answer in Settings. No content is locked and no progress is affected. Declining tracking on iOS, or notifications anywhere, costs you nothing.
• Ad content belongs to the advertiser, not to us. To report an ad, use the Report an Ad option in Settings.

• The Game contains virtual currencies — diamonds, emeralds and energy — and virtual items such as weapons, abilities, characters, skins and upgrades.
• You can play the whole Game without paying for any of them.
• Virtual items and currency are a licence to use a feature of the Game. You do not own them, they have no monetary value, they cannot be used outside the Game, and they cannot be sold, transferred, traded or exchanged for money — with us or with anyone else.
• Emeralds and energy you have paid for do not expire. They stay in your balance until you spend them or delete your account.
• We may change the price of a pack, the amount a future purchase grants, and the earn rate and effect of items in the Game as we balance it. We do not remove or reduce a balance you have already bought.
• Balances and items are tied to your account. If you delete your account, or if we end your access for a breach of these Terms, any unspent currency and every unlocked item are lost and are not refunded. See Section 12.
• If we ever discontinue the Game or a part of it, virtual items and currency in it end with it. See Section 13.

• The Game offers consumable purchases — emerald packs and energy packs, which are added to your balance and used up as you play — and one non-consumable purchase, Remove Ads.
• Purchases are processed through the app store you obtained the Game from, or through another payment method we may offer in future. That store, and not Caretta 7 Studios, is the seller for your purchase and handles payment, family approvals, taxes, chargebacks and refunds under its own terms.
• Prices are shown by the store in your own currency before you confirm, and can change.
• Remove Ads is tied to your store account, not to your Cosmic Draft account. If you reinstall the Game or move to a new device on the same store account, it is restored — the Game restores it automatically, and Settings carries a Restore Purchases option if you want to force it.
• Consumable purchases are delivered to your balance when the purchase completes and are not restorable once used, because they have been used.
• If a purchase is charged but not delivered, contact support@caretta7studios.com and tell us what you bought and when. We can restore what you paid for; we cannot return money, because we did not take it.

• Refunds are handled by the store you bought from — Google Play or the Apple App Store — under its own refund policy. We have no ability to issue a refund ourselves.
• Nothing in these Terms limits any statutory right you have as a consumer, including any right of withdrawal or cancellation, and any mandatory consumer-protection right under the law of the country where you live.
• If you are in the European Economic Area or the United Kingdom, you normally have 14 days to withdraw from a distance contract for digital content. That right, and the circumstances in which starting the download ends it, are handled by the store at the moment you buy — read the store's terms, and use the store's process. We will not stand in the way of a refund the store decides you are due.

• You can delete your account at any time from Settings › Delete Account in the main menu. Deletion is immediate.
• It removes your cloud save, your leaderboard entry and your account on our servers, and erases the progress on that device.
• Any unspent emeralds and energy are destroyed, including any you paid for. This cannot be undone and cannot be refunded. The Game says so on screen before you confirm.
• Remove Ads survives. It belongs to your store account, so reinstalling restores it.
• If you no longer have the Game installed, email support@caretta7studios.com. The full explanation, including what we cannot delete, is on our Data Deletion page (https://caretta7studios.com/games/cosmic-draft/delete-account) and inside the Game under Settings › Data Deletion.
• We may end or suspend your access if you breach these Terms. We will not do so to avoid an obligation we owe you.

• We may update the Game, and an update may be required to keep playing.
• The Game needs a compatible device, and the online parts need a connection. Most of the Game is playable offline; cloud save, the leaderboard and ads are not.
• We do not guarantee that the Game or its servers are available without interruption or free of errors.
• If we ever decide to end the Game or its online services, we will give reasonable notice through the Game or the store listing where we can. When online services end, cloud save, the leaderboard and every virtual item and currency balance end with them.

• The Game — its code, design, artwork, music, sound, text, characters and presentation — belongs to Caretta 7 Studios Inc. or its licensors, and is protected by intellectual property law.
• You may not copy, sell, distribute, modify, decompile or create derivative works from the Game, except where the law expressly allows it or we have agreed in writing.
• You are welcome to record, stream and share video of your own play, including monetised video, as long as you do not present the Game as your own and do not distribute the Game itself or its assets.

• The Game relies on services we do not control: Google Play, Google Play Games, Google Play Billing, Google AdMob, Google Firebase, and — on iOS — the Apple App Store. Each has its own terms and privacy policy, and each can change or become unavailable.
• You are responsible for complying with the terms of the store and the platform accounts you use.
• We are not responsible for third-party services or content, including the content of ads.

• A very small number of people can have a seizure when exposed to flashing lights or patterns, including while playing video games, and may have no history of seizures or epilepsy. If you or anyone in your family has ever had epileptic symptoms, consult a doctor before playing.
• Stop playing immediately and see a doctor if you experience dizziness, altered vision, eye or muscle twitching, disorientation, involuntary movement or convulsions.
• The Game's flash, bloom and screen-shake effects can be reduced in Settings. Play in a well-lit room, sit away from the screen, and take a break of at least ten to fifteen minutes every hour.

• The Game is provided "as is" and "as available".
• To the fullest extent the law allows, we disclaim all warranties, express, implied or statutory, including merchantability, fitness for a particular purpose, title and non-infringement.
• We do not warrant uninterrupted play, error-free operation, ad availability, or that progress will never be lost.
• Some jurisdictions do not allow these exclusions, in which case they do not apply to you.

• To the fullest extent the law allows, Caretta 7 Studios Inc. and its officers, employees and contractors are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, lost progress, device problems or loss of goodwill arising from the Game.
• To the fullest extent the law allows, our total liability to you for any claim relating to the Game is limited to the greater of the amount you paid for in-app purchases in the Game in the twelve months before the claim, or US$100.
• Nothing here limits liability that cannot lawfully be limited — including liability for death or personal injury caused by negligence, for fraud, and for any right you have under mandatory consumer law.
• Some jurisdictions do not allow these limitations, in which case they do not apply to you.
• If you break these Terms deliberately — cheating, tampering with the leaderboard, or using the Game unlawfully — and that causes a third party to bring a claim against us, you are responsible for that claim. This does not apply to ordinary play, to an honest mistake, or where the law where you live does not allow it.

• This section applies to you instead of Section 20.
• These Terms are governed by the law of the country where you live, and you may bring proceedings in the courts of that country. We may bring proceedings only in the courts of the country where you live.
• Nothing in these Terms removes or limits your rights under the mandatory consumer-protection and data-protection law of your country, including the GDPR and the UK GDPR.
• Your statutory right of withdrawal for digital content is described in Section 11 and is exercised through the store you bought from.
• If we cannot resolve a complaint between us, you may use the consumer dispute body or the consumer protection authority available where you live.

• If you live in the EEA, the United Kingdom or Switzerland, Section 19 applies to you instead of this section.
• These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules.
• Any dispute that is not resolved informally may be brought in the state or federal courts located in Texas, and you consent to the personal jurisdiction of those courts.
• Before starting proceedings, please email support@caretta7studios.com and describe the problem, so that we have an opportunity to resolve it.
• This section does not override Section 21 or any mandatory consumer or data-protection law where you live, including the CCPA, the Texas Data Privacy and Security Act, and KVKK.

• Nothing in these Terms limits any right you have under mandatory consumer-protection law.
• Where a rule where you live gives you a right that cannot be waived, that right continues to apply and these Terms are read accordingly.

• If you obtained the Game from the Apple App Store, these Terms are between you and Caretta 7 Studios Inc. only, and not with Apple. Apple is not responsible for the Game or its content.
• Where these Terms conflict with Apple's Licensed Application End User Licence Agreement or Apple Media Services Terms and Conditions as they apply to your purchase, Apple's terms govern that purchase.
• Apple has no obligation to provide maintenance or support for the Game. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
• You confirm that you are not located in a country subject to a US Government embargo, and that you are not on any US Government list of prohibited or restricted parties. The same confirmation applies wherever you obtained the Game, because Caretta 7 Studios Inc. is a US company and is bound by US export and sanctions law.

• We may update these Terms as the Game changes or as the law does. The date at the top shows the current version.
• If a change is material we will ask you to review it inside the Game. Continuing to play after an update means you accept the updated Terms; if you do not accept them, stop playing and, if you wish, delete your account as described in Section 12.

• Events outside anyone's control. We are not responsible for a failure or delay caused by something beyond our reasonable control — a network or platform outage, a store or service provider's decision, a change in the law, an act of government, a natural event or war.
• If part of this fails, the rest stands. If any provision is held unenforceable, it is limited or removed to the minimum extent needed and the remainder continues in force.
• Not enforcing something is not giving it up. If we do not enforce a right under these Terms straight away, we have not waived it.
• The whole agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Game, and replace anything said before. They do not affect the separate terms of the store you obtained the Game from.
• Assignment. You may not transfer your rights under these Terms. We may transfer ours to a company that takes over the Game, provided your rights are not reduced.
• Notices. We give notice through the Game, the store listing, or this page. You reach us at support@caretta7studios.com.
• Language. These Terms are written in English. If we publish a translation and the two differ, the English text is the one that governs — the translation is provided for convenience.
