Terms of Service

1. Agreement

• These Terms of Service ("Terms") are an agreement between you and Caretta 7 Studios Inc. ("Caretta 7 Studios", "we", "our", "us"), a corporation incorporated in the State of Texas, United States, for your use of Word Gust.
• By downloading, installing, accessing, or using Word Gust, you agree to these Terms and acknowledge our Privacy Policy.
• If you do not agree, do not use the app.

2. Eligibility / Age

• Word Gust is intended for users who are at least 13 years old, or the higher minimum digital-consent age required in your country (for example, up to 16 in parts of the European Economic Area).
• If you are below the applicable age, you may use Word Gust only with the permission and involvement of a parent or legal guardian, who accepts these Terms on your behalf.

3. The Game

• Word Gust is a word puzzle game with solo modes, timed challenges, rewarded ads, optional peer-to-peer friend matches, and an optional global leaderboard.
• We may update, rebalance, add, remove, or change game features over time.

4. License

• We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use Word Gust for personal entertainment on devices you own or control, subject to these Terms and the applicable app store rules.
• We and our licensors retain all rights not expressly granted to you.

5. Fair Play

• You agree not to cheat, exploit bugs, tamper with scores, modify app storage, interfere with multiplayer connections, reverse engineer the app except where allowed by law, or use Word Gust for unlawful or harmful purposes.
• We may limit or disable features if we reasonably believe they are being abused or used in a way that harms the game, its users, or our services.

6. Multiplayer

• Friend matches use temporary lobby codes and peer-to-peer connections. Only share lobby codes with people you choose to play with.
• Your emoji avatar (which you choose) and your player name — your Google Play Games / Apple Game Center alias, or a "Guest-####" label — are sent to the other player so they can see who they are playing. The app has no free-text name field.
• Word Gust does not provide chat, voice, public profiles, or free-form messaging beyond the structured game messages and the display name.
• Connection quality may vary based on network conditions, device settings, and third-party signaling/relay services.

7. Ads and Rewards

• Word Gust shows ads, including rewarded ads that grant an in-game benefit such as a reveal or revive.
• Rewards are part of gameplay and have no cash value.
• Ads may be unavailable, interrupted, or limited by region, device, network, consent/tracking choices, ad-provider rules, or inventory.

8. In-App Purchases

• Word Gust offers two kinds of in-app purchase: a one-time, non-consumable "Remove Ads" upgrade, and consumable "energy" packs (small, medium, and large) that grant in-game energy used to play.
• On Android, purchases are made through Google Play Billing. On iOS, they are made through the Apple App Store (StoreKit). Store purchase flows, family approvals, refunds, chargebacks, taxes, and payment methods are handled by the respective store and are subject to its policies.
• Because "Remove Ads" is non-consumable, you can restore it at no additional cost on the same store account if you reinstall the app or switch devices. The app provides a "Restore Purchases" option.
• Energy packs are consumable: the energy is added to your balance when the purchase completes and is used up as you play. Consumable purchases are not restorable, have no cash value, and are not exchangeable for money.
• Refunds and any statutory withdrawal rights are handled according to the policies of the store you purchased through (Apple App Store or Google Play); mandatory EU/UK consumer-withdrawal rights, where they apply, are unaffected (note that the withdrawal right may end once delivery of consumable digital content begins with your consent).
• If a purchase is not delivered, granted, or restored correctly, contact us at support@caretta7studios.com.

9. Accounts, Sign-In, and Leaderboard

• Word Gust offers an optional global leaderboard. You can play the entire game without an account; to join the leaderboard and keep your rank across devices, you sign in with Google Play Games (Android) or Apple Game Center (iOS).
• Your emoji avatar (which you choose) and your public name are shown on the leaderboard. The app has no free-text name field: your public name is your Google Play Games / Apple Game Center alias, or an automatically generated "Guest-####" label. Your alias comes from your platform gaming account, which has its own naming rules; you can change it there. We may remove any leaderboard entry that is fraudulent or that contains an offensive alias.
• If you sign in, your game progress and settings are also saved to a private cloud profile tied to your account so you can restore them on another device; this is separate from the public leaderboard. See the Privacy Policy for details.
• Scores submitted to the leaderboard must be earned through normal play. Tampered, automated, or fraudulent scores may be removed, and the account may be barred from the leaderboard.
• You can delete your account and leaderboard data at any time from within the app, by emailing support@caretta7studios.com, or via the web deletion page at caretta7studios.com/games/wordgust/delete-account.
• Other game data (settings, local high scores, legal acceptance, purchase-entitlement state) is stored locally on your device or handled by the app store. Clearing app data or uninstalling the app may remove local progress and settings.

10. Intellectual Property

• Word Gust, including its code, design, artwork, logos, audio, text, and gameplay presentation, is owned by Caretta 7 Studios or its licensors and is protected by intellectual property laws.
• You may not copy, sell, distribute, modify, or create derivative works from Word Gust except as permitted by law or with our written permission.

11. Third-Party Services

• Word Gust relies on third-party platforms and services, including Google Play, the Apple App Store, Google AdMob, Google Firebase (leaderboard, cloud save, and analytics), Google Play Games, Apple Game Center, Google STUN, and PeerJS.
• Those services have their own terms, privacy policies, availability limits, and technical requirements. We are not responsible for third-party services we do not control.

12. Disclaimers

• Word Gust is provided "as is" and "as available."
• To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
• We do not guarantee uninterrupted operation, error-free gameplay, ad availability, multiplayer connectivity, or preservation of local data.

13. Limitation of Liability

• To the fullest extent permitted by law, Caretta 7 Studios Inc. and its members, employees, contractors, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, device issues, or loss of goodwill arising from or related to Word Gust.
• Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.

14. Governing Law

• These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws principles.
• Any dispute arising out of or relating to these Terms or Word Gust that is not resolved informally may be brought in the state or federal courts located in Texas, and you consent to the personal jurisdiction of those courts.
• This section does not override the "Consumer Rights" section below or any mandatory data-protection or consumer law in your country of residence (such as the GDPR, UK GDPR, CCPA/CPRA, or KVKK).

15. Consumer Rights

• Nothing in these Terms limits rights you may have under mandatory consumer protection laws.
• If a required legal rule in your location gives you rights that cannot be waived, those rights continue to apply.

16. Changes

• We may update these Terms from time to time. The "Last updated" date above shows the latest revision.
• If we make material changes, we may ask you to review or accept the updated Terms in the app. Continued use after an update means you accept the updated Terms.
